Workers’ compensation provides injured employees with three main benefits:

1. Payment for reasonable and necessary medical care for the injury;

2. Lost wage benefits, equal to the average of 2/3 of wages just before the injury; and

3. Benefits for permanent injury or impairment.

Workers’ compensation is a “no-fault” system, meaning it provides benefits regardless of whose fault it was that the employee was injured. The trade-off for the no-fault system is employees cannot sue their employer for work injuries even if their employer is wholly at fault for the injury.

However, if a party not employed by the employer causes or contributes to the injury, an injured employee may also be able to make a claim against that party, a third-party claim, to recover damages in a personal injury claim in addition to recovering worker’s compensation benefits.
