Workers’ Compensation

  The South CarolinaWorkers’ Compensation law requires employers with a minimum number of employees to provide workers’ compensation benefits for their workers who are hurt on the job. The benefits are usually paid from the employer’s insurance company, not the employer directly. Workers’ compensation provides injured employees with 3 main benefits:

1. Payment for reasonable and necessary medical care for the injury;

2. Lost wage benefits, equal to the average of 2/3 of wages just before the injury; and

3. Benefits for permanent injury or impairment.

  Workers’ compensation is a “no-fault” system, meaning it provides benefits regardless of whose fault it was that the employee was injured. The trade-off for the no-fault system is employees cannot sue their employer for work injuries even if their employer is wholly at fault for the injury. However, if a party not employed by the employer causes or contributes to the injury, an injured employee may also be able to make a claim against that party to recover damages in a personal injury claim in addition to obtaining workers’ compensation benefits.
