We represented a very nice family victimized by a drunk driver who swerved directly into their path on East Sherwood Circle/Woodburn Road in Spartanburg, causing a devastating car accident. The at-fault driver eventually pled guilty to felony DUI. That driver only had $50,000 of liability insurance, but fortunately our client had the wisdom before the crash to have purchased underinsurance coverage (UIM). We successfully made a claim under his policies to help compensate him for his grievous leg injuries and long period of debilitation.
But the success didn't come without hard work and legal know-how. As is usually the case, our client's insurance company turned against him, refusing to pay a proper amount. That forced us to file a lawsuit. Shortly after we filed, the defense agreed to an early mediation, based on the strengths of the case we presented to them in pre-suit settlement negotiations. The case settled at mediation for $450,000.
